Demokrathaber: Civil disobedience withdrawn from case for sick detainees who were not released

Lawyer Bişar Abdi Altınak submitted his petition to the court stating that he withdrew from the case file in order to react to the fact that his 2 ill detained clients were not released despite the risk of life.

Mustafa Yardımcıel (65), who was detained and arrested in Kars on October 1, 2020 ) and İzzet Altığ (58) with the allegation of "being a member of a terrorist organization", were held at the Kars 2nd High Criminal Court on March 9. He decided to continue detention."

Atty. submitted his withdrawal petition to Kars 2nd High Criminal Court. Altınak mentioned that the clients' requests for release were rejected on the grounds of "catalog crimes".

Alınak stated that his client Mustafa Yardımcıel has a heart disease, has 2 stents in his heart, and has high diabetes and blood pressure diseases, and included the following statements in his petition:

"Your court did not take into account the fact that 58-year-old İzzet Altığ had a heart attack and angiography in prison, and that he lost 5 kilos due to this disease. Your court has made an unconscionable decision. The fact that the clients are in prison despite their existing illnesses is worrying for their lives. However, your court has disregarded the health and right to life of the clients.”

OBJECTIVITY LOST

Noting that the court lost its objectivity with its decision, Alinak pointed out that the case file was prepared with political motives.

Alınak continued with the following statements in his petition: "Because the detentions regarding the accusations that have been proven since 2012 coincided with the appointment of a trustee to Kars Municipality. The press statements, funeral ceremonies, peace tents that the clients attended 8-9 years ago The fact that their departure coincided with the appointment of a trustee and their arrest proves my thesis. Working as a lawyer in these cases and cases where your court has lost its objectivity and impartiality does nothing more than legitimizing the decisions. It is impossible for me to accept this situation legally and conscientiously."
